These Terms of Service ("Terms") govern your access to and use of our website, products, services, and communication systems (collectively, the "Services").
By accessing or using any of our Services, you agree to be bound by these Terms.

1. Our Services

Agavue Marketing provides AI-driven digital marketing and automation services, including but not limited to:

SEO and GMB optimization
AI automation and CRM integration
Social media management
Website builds and redesigns
Reputation management

All services are powered by third-party platforms (such as GoHighLevel) and custom AI systems built and maintained by Agavue Marketing.

2. Client Responsibilities

By using our Services, you agree to:

Provide accurate and complete business information
Maintain access to login credentials provided by us
Use our AI tools and workflows responsibly and ethically
Refrain from sharing unauthorized access to our systems

You are responsible for reviewing and understanding all automations and communications sent on your behalf.

3. Billing, Payments & Processing Fee Policy

Payment Methods Accepted: ACH / bank transfer, credit cards, debit cards, and approved payment links provided by our team.
Processing Fee Policy: A 3% convenience fee applies to all credit/debit card transactions to cover bank and network processing costs.
💡 Tip: Avoid this fee entirely by paying via ACH / bank transfer (no additional fee).
Payments Due: All payments are due in advance of services being rendered.
Subscriptions: All subscription services renew automatically unless canceled before the next billing date.
Setup Fees: Any applicable setup fees are non-refundable once work begins.
Chargebacks & Payment Disputes: Any chargeback or dispute will result in immediate suspension of services until resolved.

4. Late Payments

Payments more than 7 days late may result in:

Temporary suspension or pause of active services until the account is brought current
Possible termination of services if payment is not received after 14 days

5. Refunds & Cancellations

Due to the custom nature of our work, all sales are final.
We do not offer refunds for partially completed service cycles.
If something is wrong, contact us — we will work with you to make it right.
Cancellations must be submitted in writing to [email protected].

6. Communication Consent

By using our services or filling out our forms, you agree to receive SMS, email, and phone communications from Agavue Marketing.
You may opt out at any time by replying STOP to SMS messages or using the unsubscribe link in emails.

7. Confidentiality & Data Use

All client information shared with Agavue Marketing will be kept confidential and used only to deliver agreed-upon services.
We do not sell or share client data with third parties, except as required to operate integrations or comply with the law.

8. Intellectual Property

All graphics, templates, systems, and AI flows created by Agavue Marketing remain our intellectual property unless otherwise agreed.
Client websites, logos, and brand assets remain the property of the client.

9. Limitation of Liability

Agavue Marketing shall not be liable for:

Loss of income due to service delays or platform outages
Misuse of AI tools configured by the client without oversight
Changes to third-party algorithms (e.g., Google or Facebook)
In no event will our total liability exceed the amount paid for the month in which a claim arises.
